Speciale voorwaarden demorit aanvraag
Yamaha Motor Nederland B.V. is niet verantwoordelijk voor elke vorm van geleden schade veroorzaakt door het maken van een demorit bij een Yamaha Motor Dealer.
Wedstrijdregels:
Hoe deel te nemen
Er kan alleen deelgenomen worden aan de wedstrijd via de website van Yamaha Motor Nederland B.V., www.yamaha-motor.nl, op de verstrekte vorm. Er is geen grens aan het aantal inzending per persoon, maar elke inzending moet afzonderlijke ingestuurd worden. Deze vorm moet minstens de gegevens van de deelnemer bevatten, te weten; volledige voor- en achternaam, e-mailadres en alle andere met een ster gemarkeerde velden. Alleen .JPG afbeeldingen zullen worden goedgekeurd, de aangewezen grootte is max.3 Mb van de afbeelding. Alle ingestuurde afbeeldingen zullen het bezit van Yamaha worden. De deelnemer geeft Yamaha hierbij onherroepelijk alle rechten van de afbeeldingen, zonder limiet, alle copyrights omvattend, welke Yamaha hierbij goedkeurt.
Geschiktheid
De wedstrijd is toegankelijk voor wereldburgers. De werknemers van Yamaha, de filialen, moedermaatschappij, reclame- of promotiebureaus, evenals directe families en de leden van het huishoudens mogen niet participeren aan de wedstrijd.
Prijzen
Één winnaar zal aan het eind van de actie worden gekozen en zal gekenmerkt worden op de Yamaha website, www.yamaha-motor.nl. Geen prijsoverdracht of substituut wordt toegelaten, behalve door Yamaha Motor Nederland B.V., die zich het recht voorbehoudt prijzen te wisselen. De prijzen kunnen niet voor contant geld worden ingeruild.
Deelname
Ieder ingestuurde afbeelding moet nieuw, origineel en onbelast zijn en mogen geen rechten van derde overtreden. Alle beelden moeten een product van Yamaha omvatten. Al het beeldmateriaal zal het bezit van Yamaha Motor Nederland B.V. worden, welke het recht heeft alle afbeeldingen uit te geven, aan te passen en te publiceren en deze beelden in elke vorm van media zonder toewijzing of compensatie te gebruiken. Met het uploaden van een afbeelding staat de deelnemer zijn onherroepelijke recht en overdracht af aan Yamaha Motor Nederland B.V. en al rechten, titel en het belang in de afbeelding, die zonder beperking, alle auteursrechten omvatten. Yamaha staat voor veilig rijden en varen. De foto afbeeldingen zullen slechts goedgekeurd worden wanneer de bestuurders beschermende kleding, helmen, etc. dragen. Beelden die gevaarlijke situaties zoals stunts of excessief hard rijden of varen tonen worden niet goedgekeurd. Afbeeldingen en verhalen die niet het milieu, nationale en lokale wetten eerbiedigen zullen niet goedgekeurd worden.
Afstaan van rechten en verklaring van afstand
Alle ingestuurde materialen zullen het alleen bezit van Yamaha en haar filialen worden. De deelnemer geeft Yamaha hierbij onherroepelijk alle rechten van de afbeeldingen, zonder limiet, alle copyrights omvattend, welke Yamaha hierbij goedkeurt. De deelnemer rechtvaardigt dat hij geschikt is en het recht heeft om het beeld af te staan en vergoedt en houdt Yamaha daarmee onschadelijk voor alle claims van derden. Yamaha en haar filialen en/of dochterondernemingen hebben het recht om bovengenoemde rechten zonder toewijzing of compensatie uit te oefenen. De deelnemer waarborgt dat de afgebeelde persoon of personen geen bezwaar hebben tegen het publiceren van de beelden of verder gebruik van het beeld. Deelnemer doet hierbij afstand van alle morele rechten op de ingestuurde materialen.
De selectie van de winnaar
De ingestuurde materialen zullen door een panel worden beoordeeld dat uit de werknemers van Yamaha Motor Nederland B.V. wordt samengesteld. De beoordelende criteria zullen omvatten; verhaal achter en de kwaliteit van het voorgelegde beeld. Het besluit is definitief en niet-onderhandelbaar. Door de prijs te accepteren, gaat de deelnemer akkoord met het gebruik door Yamaha of haar filialen of dochterondernemingen van hun naam, biografische informatie, beeld, portret, commentaren, beeld, en/of gelijkenis voor reclame, handel of bevordering zonder verdere compensatie of overweging, in elke en alle media nu gekend of hierna over de hele wereld ontwikkeld, zoals die door toepasselijke wet wordt toegelaten. Er moeten minimaal 15 inzendingen zijn om de wedstrijd geldig te verklaren, indien er minder inzendingen zijn, zal er geen prijs worden uitgereikt.
Privacy
De deelnemer gaat vrijwillig en ondubbelzinnig akkoord dat Yamaha de persoonsgegevens van de deelnemer door de deelnemer gestuurd aan Yamaha in de context van deze wedstrijd zal verwerken. Yamaha zal deze persoonsgegevens op een juiste en zorgvuldige manier voor het toelaten van Yamaha om de winnende deelnemer overeenkomstig de toepasselijke nationale privacywetten, met inbegrip van het Nederlandse Akte van Persoonsgegevens te contacteren verwerken.
Disclaimer
De deelnemer vrijwaart Yamaha voor alle verwondingen, verliezen of schade die een persoon of bezit heeft opgelopen als gevolg van acceptatie of gebruik van de prijs of deelname van de wedstrijd. Inclusief door het gebruik van, of downloaden vanaf de Yamaha website, alsmede recente, verloren of verkeerd gerichte aanmeldingen of e-mail, of voor technische, hardware of softwaredefecten, verloren of niet beschikbare netwerkverbindingen, onschadelijk of het ontbreken, onjuist, onnauwkeurig, onvolledig, verminkt of vertraagden elektronische communicatie hetzij die door de afzender of door de geprogrammeerde materiaal wordt veroorzaakt, verbonden aan of gebruikt in deze wedstrijd of door een menselijke fout die in de verwerking van inzendingen kan voorkomen. Met participatie van de wedstrijd aanvaart en begrijpt de deelnemer volledig en onvoorwaardelijk de overeenkomst en de hiermee bevatte voorwaarde. Yamaha behoudt zich het recht om elke deelnemer te diskwalificeren die door Yamaha in schending bevonden wordt met in de disclaimer bepaalde voorwaarde. Yamaha's besluit om een specifieke maatregel niet op te nemen in deze disclaimer vormt geen goedkeuring voor de desbetreffende maatregel of de voorwaarde hiervan.
Geschillen
De wedstrijd wordt geregeerd middels de Nederlandse wet. Als voorwaarde om aan deze wedstrijd deel te nemen gaan de deelnemers akkoord dat elk en alle geschillen die niet tussen partijen kunnen worden opgelost, en oorzaken die vanuit de actie voortkomen of verbonden is aan deze wedstrijd, individueel en door het vakkundig hof van Amsterdam, Nederland zullen worden opgelost. Yamaha heeft redactiecontrole over de ingestuurde materialen door deelnemers aan de wedstrijd, noch in dit opzicht maakt het geen garanties. Alle informatie, met inbegrip van de publicatie van de beelden en/of de verhalen dat wordt ingezonden door deelnemers aan dit forum is het op eigen risico en verantwoordelijkheid van de deelnemers. Yamaha rechtvaardigt in geen geval dat deze informatie correct en/of volledig is, of dat de persoon die deze informatie voorlegt het recht heeft om dit te doen. Yamaha is niet verantwoordelijk of aansprakelijk voor schade of andere ongunstige gevolgen die door het gebruik van de inzending of elke andere vorm of manier wordt veroorzaakt.
