In this privacy statement we explain how we collect and process your personal data, including who is responsible for the processing of your personal data as a data controller, which personal data we collect and process, and how we store your personal data. We explain this per activity or topic category, so you can more easily find the relevant information depending on your choices or activity, such as when you register for our (factory or extended) warranty, use our websites, My Yamaha account or apps, or participate in one of our racing events or adventures. 2: To which activities does this privacy statement apply?

This privacy statement applies to our processing of your personal data as our (potential) customer, user, (racing) participant or visitor in relation to all your interactions with our websites, apps, events, competitions, service, sales and dealer contacts, customer information and support, quality assurance, and all other activities or topics included in the overview below. The personal data we collect and process of you depends on your choices and interactions with us or our partners (for example: authorized dealers, distributors, travel agencies, insurers), such as when you create a My Yamaha account. Accordingly, depending on your situation, we will process your personal data in relation to the activities and topics below.

In some situations, we may have separate supplemental privacy notices for certain activities or topics to tailor the information even better to your specific choices or activity at a specific moment. 3: Who is responsible for the processing of your personal data?

We strive to create exceptional value and deep satisfaction surpassing customer expectations. This includes that we take our responsibility as data controller to protect your personal data very seriously. Yamaha Motor Europe N.V. (YME) is the regional headquarter of the Yamaha Motor group in Europe, with its branch offices and group companies located in the European marketplace. It is responsible for coordinating the marketing, services, and sales activities of Yamaha Motor products in the European marketplace, including Yamaha motorcycles and scooters, marine outboard engines, Wave runner water vehicles, 4-wheel All-Terrain Vehicles (ATVs), golf cars, snowmobiles and generators, and the provision of services such as via our apps or My Yamaha.

YME's relationship with its group companies within the Yamaha Motor group

As the regional headquarter, YME is the data controller for the processing of your personal data by, under the responsibility or on behalf of YME, including its branch offices and subsidiaries in the European Economic Area. As a global company, we have group companies in different countries, including our parent company Yamaha Motor Co., Ltd. in Japan. These YME-subsidiaries and other group companies sometimes process your personal data and are responsible for the processing of your personal data together with YME, depending of these group companies' activities and responsibilities and also the country you are residing in. Yamaha Motor Co., Ltd. In Japan will for example also be responsible for quality assurance and product development purposes. In those situations, YME will remain the data controller, together with the relevant Yamaha Motor group company, and will be responsible for how your personal data are processed, how you are informed thereof, and ensuring your rights as a data subject. For simplicity, where we refer to "Yamaha Motor", "we", "us", or "our", in this privacy statement, we mean YME as the main data controller responsible for the processing of your personal data and all its other group involved as relevant joint data controllers.

Our authorized dealers, distributors, and other partners

Depending on your choices and activities, we will receive from, or share, certain personal data with our dealers, distributors, and other third parties acting also as joint data controllers responsible for the processing of your personal data. This will take place to provide you a specific product or service you requested from us, our distributors, or dealers, or allow you to participate in one of our events or competitions. Depending on your choices and activities, such parties usually include authorized dealers, distributors, telecom and anti-theft monitoring providers, insurers, tour operators, event organizers, and social media providers. In addition to us, these parties are also responsible for the processing of your personal data. Where relevant, we inform you on such partners and other third parties and the division of responsibility for protecting your personal data specifically per topic below.

5: How do we secure your personal data?

We are committed to ensuring that your personal data is kept secure. To prevent unauthorized access, disclosure or loss, we have put in place appropriate technical and organizational measures to safeguard the personal data we process, such as encrypting of connections and equipment, making back-ups, limiting and control of authorizations, and using multi-factor authentication.

6: How do we transfer your personal data internationally?

Your personal data will be transferred to recipients in a location outside of the Economic European Area (EEA). When your personal data are transferred outside the EEA, we are required to ensure that it is subject to an equivalent level of protection as it would within the EEA. We take the steps necessary to ensure that your data is kept securely and handled in accordance with this privacy statement and applicable laws.

Transfers to third countries based on the official unchanged Standard Contractual Clauses
We transfer personal data to countries that are not considered to provide an adequate level of protection according to the applicable data protection laws. When we do so, we have taken appropriate (supplemental) safeguards to ensuring an equivalent level of data protection by concluding Standard Contractual Clauses approved by the European Commission with the receiving party located in such third country (in accordance with article 46.2(c) of the General Data Protection Regulation).

Transfers to our group head offices and other group companies in Japan
We transfer personal data to our parent company Yamaha Motor Co., Ltd. and group companies established in Japan. Japan is a country recognized by the European Commission as providing an appropriate level of data protection, in accordance with article 45 of the General Data Protection Regulation (see here for the European Commission's adequacy decision for Japan). This means that the mandatory rules on protecting your personal data of the EU, including the adequacy decision, and Japan continue to apply if we transfer your personal data to our head offices and group companies in Japan.

Next to this, we have taken additional measures for the transfer of personal data to Japan by concluding the Standard Contractual Clauses approved by the European Commission with our head offices and group companies in Japan (in accordance with article 46.2(c) of the General Data Protection Regulation). As such, our group companies in Japan are also contractually bound to provide an equivalent level of data protection when processing your personal data. Your personal data is accordingly protected equivalent to the protection offered in the EU if your personal data are transferred to Japan.

Transfers to adequate countries
Depending on you location and the services you use, we also transfer personal data recognized by the European Commission as providing an appropriate level of data protection, such as the United Kingdom (see here a list of adequacy decisions taken by the European Commission).

7: Which rights do you have?

As a data subject, you have certain rights concerning our processing of your personal data. You can:

• Request access to your personal data held by us: you can ask us whether we process your personal data and, if so, provide you with a copy of that personal data.
• Request us to rectify or complete your personal data: If you believe that the personal data we process about you is inaccurate or incomplete, you can ask us to rectify your data. If you have a My Yamaha account, you can also update certain of your personal data via your account.
• Request us to erase certain personal data: You can ask us to delete or remove your personal data in some circumstances.
• Request us to restrict the processing of your personal data: You can ask us to restrict the processing of your personal data in some circumstances, such as when you contest the accuracy of the personal data.
• Object to our processing of your personal data: You can object to our processing of your personal data and ask us to stop such processing at any time if we rely on our own or someone else’s legitimate interests to process your personal data or where we process your personal data for direct marketing purposes. When we rely on legitimate interests, we may continue processing your personal data if we can demonstrate compelling legitimate grounds, which we will consider on an individual basis. Where you object to our processing for direct marketing purposes, we will stop processing your personal data for such purposes.
• Request not to be subject to automated decisions, including profiling: You have the right not to be subject to a decision based solely on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you. We do not use such automated decision-making in relation to our processing of your personal data described in this privacy statement.
• Request to port your personal data: You have the right, in certain circumstances, to obtain personal data you have provided to us (in a structured, commonly used, and machine-readable format) and to reuse it elsewhere or to ask us to transfer this to a third party of your choice.
• Request to withdraw your consent: If we rely on your consent for processing your personal data, you have the right to withdraw that consent at any time. Such withdrawal will not affect the lawfulness of the processing before you withdrew your consent.
• Lodge a complaint with a supervisory authority: If you have a concern about the way we have handled your personal data, you can lodge a complaint with your local supervisory authority.

We will handle your request carefully and respond to you without undue delay and at the latest within one month of receipt of your request in line with the applicable data protection rules. We may need to identify you and obtain proof of your identity to be able to respond to your request.
