Privacy Statement - Yamaha Motor Europe MyRide App

Yamaha Motor believes privacy is an important right and attaches great importance to the protection of your personal data. With ingenuity and passion, we strive to offer new excitement and a more fulfilling life for people with safe and high-quality products, services, and events. To provide you the best adventure and experience, we need to process your personal data in some situations, but we only do so when needed. We believe that your Yamaha product and service, and the adventures you experience with them are a valuable part of your private life. It should also be clear to you which personal data you share with us and what we do with your personal data, together with our branch offices, group companies, distributors, dealers, and other partners. We are committed to protect your personal data.

The Yamaha Motor MyRide App is provided by Yamaha Motor Europe N.V., also on behalf of its branch offices and related affiliates (further referred to as we, us/our). The App allows you to enjoy your Yamaha motorcycle even more by offering many features and functionalities, such as tracking your routes, riding suggested routes, access to the Yamaha Community, which provides you the possibility to invite, share with, and challenge your friends, and save achievements. You can read more on your rights and obligations about your use of the App in our Terms of Use applicable to your App use.

At a glance:

  • We need to process certain of your personal data to provide the App's features and functionalities, including location data and speed for tracking routes and remembering your last parked location if you have provided your consent.
  • This is especially the case if you have created a My Yamaha Account to join the Yamaha Community to keep track of your route details and other experiences, share them with friends and use additional fun features of the App.
  • Only if you provide your consent, we use an analytics partner (Google Firebase and Apple App Store Analytics for iOS) to analyze in general how many persons download the App and how they use the App, such as in which season most users are active, so we can make the App even better.
  • If you have paired your Connected Yamaha Motor, such as the NMAX, in the App, you can keep track of your vehicle data, meaning your fuel consumption, battery status, oil status, when maintenance is recommended, malfunction notifications, and automated last parked and last known location.
  • These vehicle data from your Connected Yamaha Motor are shared with us, and our parent company, Yamaha Motor Co. Ltd. in Japan. These data are only shared with us and transferred to Japan for hosting purposes, and only if you provide consent to collect and analyze vehicle data of our Connected Yamaha Motor users to track its malfunctions and performance on an aggregated basis and improve the technical quality of our products
  • Pairing the app with your Connected Yamaha Motor, also allows you to receive notifications for incoming calls and messages on your Connected Yamaha Motor. These data remain on your devices and are not shared with us. Please always follow instructions and applicable laws to ensure your and your surrounding's safety.

In this specific privacy statement for the App, we explain how we collect and process your personal data, including who is responsible for the processing of your personal data as a data controller, which personal data we collect and process, and how we store your personal data.

This privacy statement will be updated from time to time, such as when there are new developments or changes in how we process your personal data. We will inform you on material changes in this privacy statement via our usual communication channel with you, such as via email, the App, your Account, and/or our websites. This privacy statement does not see to the processing of personal data that is not related to the App.

1: To whom does this privacy statement apply to?

This privacy statement is aimed specifically at anyone who uses our App, whether you have created an Account or have a Connected Yamaha Motor or not and applies to our processing of your personal data as our valued App user. You can be just an App user without an Account, an App user with an Account, or a person who received an invitation from another App user. The personal data we collect and process of you depends on your choices and interactions with us and our partners (for example: authorized dealers), such as when you create an Account.

2: Who is responsible for the processing of your personal data?

We strive to create exceptional value en deep satisfaction surpassing customer expectations. This includes that we take our responsibility as data controller to protect your personal data very seriously. Yamaha Motor Europe N.V (YME) is the regional headquarters of the Yamaha Motor group in Europe, with its branch offices and affiliates located in the European marketplace. It is responsible for coordinating the marketing, services, and sales activities of Yamaha Motor products in the European marketplace, including services such as the App and your Account.

YME's relationship with its affiliates within the Yamaha Motor group

As the regional headquarters, YME is the main data controller for the processing of your personal data by, under the responsibility or on behalf of YME, including its branch offices and subsidiaries in the European Economic Area. As a global company, the Yamaha Motor group has also affiliates in different countries, including our parent company Yamaha Motor Co., Ltd. in Japan. These YME-subsidiaries and its affiliated entities within the Yamaha Motor group sometimes process your personal data and are responsible for the processing of your personal data together with YME according to these affiliates' activities and responsibilities and the country you are residing in, for example for data hosting purposes by Yamaha Motor Co., Ltd. In those situations, YME will remain the main data controller, together with the relevant Yamaha Motor group affiliate(s). You can find a list of our affiliates here. For simplicity, where we refer to "Yamaha Motor", "we", "us", or "our", in this privacy statement, we mean YME as the main data controller responsible for the processing of your personal data, under applicable (local) data protection laws of the European Economic Area, within the entire Yamaha Motor group and all its other affiliates involved as relevant data controllers.

Our dealers

Depending on your choices and activities, we will also receive from or share certain personal data with our authorized dealers acting also as data controllers responsible for the processing of your personal data. This will take place to provide you a specific product or service you requested from us and our dealers. In addition to us, your authorized dealer is then also responsible for the processing of your personal data.

3: How did we obtain your personal data?

We will collect and process your personal data in relation to the App if you:

  • Create or use your Account with the App;
  • Pair your Connected Yamaha Motor with the App and provide your consent to share the vehicle data generated by your Connected Yamaha Motor and App.

4: When do we collect and process your personal data and which personal data do we process about you?

If you use the App with an Account

If you would like to have a more personal App experience, upload your own content to your Account and connect with friends or other co-riders via the Yamaha Community, you may choose to create an Account.

Which personal data do we process when you create and use an Account?
If you create and use an Account for the App, we process the following personal data of you:

If you create and use an Account for the App, we ask you to provide the following personal data (your Account information):

  • First and last name.
  • Log-in details: username and password.
  • Country of use of the App.
  • Contact details: email address.
  • Profile picture (optional)

If you create an Account, we will also process your:

  • IP-addresses and your unique user/device ID associated with your Account to enable you to use your Account and receive notifications.
  • Log-in details: username and password.
  • Time and date of your log-ins.
  • Information you provide on your Yamaha Motor unit(s): vehicle identification number, model, type, license plate number.
  • Phone number (optional).
  • Content you uploaded to and other interactions on the Yamaha Community:
    • Your invited and linked friends.
    • Content, such as videos, photos, personal notes, you or other users submit and share.
  • App preferences (such as push notifications and language preferences).
  • Achievements, ride ratings and ride favorites.
  • Active or completed challenges, and any invited/participating friends or co riders.
  • Location data of your tracked, saved and/or shared routes with the geolocation data of your route, local weather, time, date, duration, distance, acceleration, average speed, altitude, your lean angles. You can choose to share this data with your linked friends or the Yamaha Community. You can change which information you want to share in your Account settings. Your current location data is also used to suggest routes and show the weather.
  • Suggested routes you have ridden.
  • Your Facebook information if you choose to invite friends via Facebook.
  • Whether you wish to receive information and updates from us.



Why do we process this personal data and what are the legal grounds for processing your personal data?
We use your personal data for the following purposes, based on the following legal grounds applicable to the listed purposes:

  • To allow you to create and use the functionalities of your Account.
Performance of a contract with you: we process your personal data to provide the functionalities of your Account and Yamaha Community.
  • To exercise or defend legal claims.
  • Allow your friend to invite you or interact with you.
  • If you provided consent to receiving general marketing communications on Yamaha Motor products, events, competitions, and services, to send you such marketing communications and maintain contact with you.
  • If you provided consent, to use your location data to provide specific functionalities of the App (for example to suggest routes and show the weather)
  • If you use these features, to share your experiences, including tracked routes and details such as your speed with your linked friends or the Yamaha Community.
  • If you provided consent to send you push notifications.
  • If you provided consent, to analyze your use of the App with the use of an analytics partner (Apple App Store Analytics for iOS and Google Firebase for Android) and based on the gained insights further develop, resolve issues, and improve the App, Accounts, and the Yamaha Community.
  • If you provided consent, to send your personal data to your dealer for sales purposes.
  • If you opted to use a social media log-in.

Legitimate interests:
We may process your personal data as necessary for achieving our and/or others' legitimate interests.

  • We will have a legitimate interest to process your personal data in case of any disputes.
  • We and your friends have legitimate interest to process your personal data to allow Yamaha Community interactions.

Consent:
You can withdraw your consent at any time at the bottom of every newsletter you receive, via your Account settings, your device settings or by contacting us using the contact details below.

  • To maintain the security in general and of your use of the App and Accounts.
  • To comply with a legal obligation, including accounting and data retention obligations, court orders or requests from authorities. 

Legal obligation:
We process your personal data when necessary for complying with one of our legal obligations.

  • We are required to ensure the security of our processing of personal data.
  • We need to process your personal data to comply with any other legal obligation.


The provision of your Account registration details is mandatory if you would like to create an Account. We kindly request you to keep your Account Information updated. Your Account will be set on private by default. This means that only your linked friends within the Yamaha Community will be able to see your Account information. If you wish so, you can also switch your Account's privacy setting to public. As a result, other Yamaha Community users who are not (yet) your linked friends will be able to see your Account information as well.

Social media/easy sign and log-in: You can also choose to quickly create an Account and easily login with your social media profile from your Facebook or your Google account, or sign in with Apple. If you use one of these options, we will also process your name and email address, together with an account identifier, from your (social media/easy sign in) profile for the purposes of validating and authenticating your Account and logins and automatically filling in your account details. You can at any time delete your entire Account by logging in or remove the authorization via your profile on the website of your social media provider. You can find more information on the privacy settings of your social media profile and how you can withdraw authorization on the website of your social media provider (see here for Facebook). Please note that because of using your social media profile, the relevant social media provider will also process your personal data as data controller, including information on your access to our websites and/or apps. We have no control over and are not responsible for the processing of your personal data by such third-party social media provider. Account deletion: By permanently deleting your Account, the functionalities requiring an Account will not be available anymore, and your personal data in relation to your use of the App as associated with your Account will also be deleted. As soon as you confirm that you indeed want to delete your Account and the deletion process starts, you will not be able to reactivate your account or retrieve any information from your account. If you however want to keep certain of your personal data associated with your Account, make your own local copy, or send us a request for a copy of your data using the contact details below before deleting your Account.

Please note that your deletion of your Account will not affect our processing of your personal data for other purposes unrelated to your Account, such as for accounting purposes, to provide you our warranty services or to perform our legal obligations.

If you pair a Connected Yamaha Motor to your App

Which personal data do we process when you create and use an Account?
In addition to the personal data processed if you create and use an Account, we process the following personal data of your vehicle if you pair your Connected Yamaha Motor to the App and provide your consent:

  • Vehicle data from the Communications Control Unit of your Connected Yamaha Motor
    • Fuel consumption.
    • Battery status.
    • Oil status.
    • Last parked and last known location.
    • Maintenance requirements (when maintenance is recommended).
    • Malfunction notification from the Connected Yamaha Motor.
  • Unique device ID.


  • Why do we process this personal data and what are the legal grounds for processing your personal data?
    In addition to the purposes mentioned above if you use an Account, we use your personal data for the following purposes if you pair your Connected Yamaha Motor with the App, based on the following legal grounds applicable to the listed purposes:

    • To allow you to pair your Connected Yamaha Motor with the App via your devices Bluetooth connection.
    • To allow you to receive incoming calls and messages notifications on your Connected Yamaha Motor.
    • To allow you to keep track of your vehicle data easily from the App.
    • To notify you of required maintenance and allow you to have your Connected Yamaha Motor serviced on time.
    • To share the vehicle data together with your unique user ID with our parent company in Japan and analyze the vehicle data to track the Connected Yamaha Motor's malfunctions and performance in general and improve the technical quality of our products with the insights we gain from your vehicle data.
    Consent:
    You can withdraw your consent at any time at the bottom of every newsletter you receive, via your Account settings, your device settings or by contacting us using the contact details below.
     
    • To maintain the security in general and of your use of your Connected Yamaha Motor.
    • To comply with a legal obligation, including accounting and data retention obligations, court orders or requests from authorities.

    Pairing your Connected Yamaha Motor with the App is optional. If you do not pair your Connected Yamaha Motor, you will not be able to use the connected features.

    If you use the App without an Account
    If you do not have an Account, we will generally not process your personal data in connection with your use of the App. All data will be stored on your own Device only and will not be transmitted to our servers. As a user without an Account, you will only be able to store one configuration of your motorcycle on your Device and will not be able to send configurations to your dealer, store tracked routes, store dealer information, or use Yamaha Community features, such as inviting, sharing with, and challenging your friends, and achievements. We may process your email address if someone with an Account sends you an invitation to join the Yamaha Community and link as friends. If you do not yet use the App, we may process your email address if another App user with an Account sends you an invitation to join the Yamaha Community and links you as a friend, and if you would then accept such invitation.

    Purposes Legal grounds

    We may process your personal data as necessary for achieving our and/or others' legitimate interests.

    • We will also have a legitimate interest to process your personal data in case of any disputes.

    5: Who will have access to my personal data?

    If you use the App without an Account and without pairing a Connected Yamaha Motor, your personal data will generally remain on your Device. Depending on your choices, your personal data will be processed by persons working for or on behalf of us on a need-to-know basis for the purposes described above. We also use services of third parties who processes your personal data on our behalf, acting as a data processor, such as for providing App and data hosting and customer management services. In each case, we have concluded appropriate data processor agreements in line with the applicable data protection laws.

     

    Category of recipient

    Social media provider: If you choose to create and log-in to an Account using the authentication services provided by your social media provider.
    Public information: If you switch your Account's privacy settings, which are set on private by default, to public to publicly share your experiences.

     


    We will not disclose your personal data to others than described in this privacy statement unless we consider it necessary for complying with our legal obligations or protecting our or others' rights.

    6: How long do we retain your personal data?

    We will keep your personal data only for so long as necessary for the described purposes. If you have created an Account, we will retain all your information associated with your Account until you amend or delete any of such information in your Account or if you delete your Account by contacting us using the contact details below. You can also amend and delete any of your linked friends, tracked routes, completed challenges, and configurations of motorcycles via the App.

    You can specifically delete your Connected Yamaha Motor data (vehicle data) from your own device by uninstalling your App and thereby disconnecting the Connected Yamaha Motor from the App and by sending your request for deletion using the contact details included below.

    7: How do we secure your personal data?

    We are committed to ensuring that your personal data is kept secure. To prevent unauthorized access, disclosure, or loss, we have put in place appropriate technical and organizational measures to safeguard the personal data we process, including encrypting your personal data when stored and in transit.

    8: How do we transfer your personal data internationally?

    Your personal data will be transferred to a location outside of the Economic European Area (EEA). When your personal data are transferred outside the EEA, we are required to ensure that it is subject to an equivalent level of protection as it would within the EEA. We take the steps necessary to ensure that your data is kept securely and handled in accordance with this privacy statement and applicable laws.

    Transfers to third countries based on Standard Contractual Clauses of the European Commission
    We transfer personal data to countries that are not considered to provide an adequate level of protection according to the applicable data protection laws. When we do so, we have taken appropriate (supplemental) safeguards to ensuring an equivalent level of data protection by concluding Standard Contractual Clauses approved by the European Commission with the receiving party located in such third country in accordance with article 46.2(c) of the General Data Protection Legislation.

    Transfers to our group head offices and affiliates in Japan
    We transfer personal data to our parent company Yamaha Motor Co., Ltd. and affiliates established in Japan. Japan is a to country recognized by the European Commission as providing an appropriate level of data protection, in accordance with article 45 of the General Data Protection Regulation (see here for the European Commission's adequacy decision for Japan). This means that the mandatory rules on protecting your personal data of the EU, including the adequacy decision, and Japan continue to apply if we transfer your personal data to our head offices and affiliates in Japan.

    Next to this, we have taken additional measures for the transfer of personal data to Japan by concluding the Standard Contractual Clauses approved by the European Commission with our head offices and affiliates in Japan in accordance with article 46.2(c) of the General Data Protection Regulation. As such, our group companies in Japan are also contractually bound to provide an equivalent level of data protection when processing your personal data. Your personal data is accordingly continually protected equivalent to the protection offered in the EU if your personal data are transferred to Japan.

    You can contact us using the contact details below, if you would like to receive more information on the measures, we have taken to safeguard your information if it is transferred outside the EEA.

    9: Which rights do you have?

    As a data subject, you have certain rights concerning our processing of your personal data. You can:

    • Request access to your personal data held by us: You can ask us whether we process your personal data and, if so, provide you with a copy of that personal data.
    • Request us to rectify or complete your personal data: If you believe the personal data we process about you is inaccurate or incomplete, you can ask us to rectify it. If you have an Account, you can also update certain of your personal data via your Account.
    • Request us to erase certain personal data: You can ask us to delete or remove your personal data in some circumstances.
    • Request us to restrict the processing of your personal data: You can ask us to restrict the processing of your personal data in some circumstances, such as when you contest the accuracy of the personal data.
    • Object to our processing of your personal data: You can object to our processing of your personal data and ask us to stop such processing at any time, if we rely on our own or someone else’s legitimate interests to process your personal data or where we process your personal data for direct marketing purposes. When we rely on legitimate interests, we may continue processing your personal data if we can demonstrate compelling legitimate grounds, which we will consider on an individual basis. Where you object to our processing for direct marketing purposes, we will stop processing your personal data for such purposes.
    • Request not to be subject to automated decisions, including profiling: You have the right not to be subject to a decision based solely on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you. We do not use such automated decision-making.
    • Request to port your personal data: You have the right, in certain circumstances, to obtain personal data you have provided to us (in a structured, commonly used, and machine-readable format) and to reuse it elsewhere or to ask us to transfer this to a third party of your choice.
    • Request to withdraw your consent: If we rely on your consent for processing your personal data, you have the right to withdraw that consent at any time. Such withdrawal will not affect the lawfulness of the processing before you withdrew your consent.
    • Lodge a complaint with a supervisory authority: If you have a concern about the way we have handled your personal data, you can lodge a complaint with your local supervisory authority.

    You may send us such request using the contact details below. We will handle your request carefully and respond to you without undue delay and at the latest within one month of receipt of your request in line with the applicable data protection rules. We may need to identify you and obtain proof of your identity to be able to respond to your request. If you feel that we have not handled your request satisfactory, or if you have a complaint, you can also contact our Data Protection Officer (dpo@yamaha-motor.nl).
